Haccah Solutions Inc. (“Haccah,” “we,” “us” or “our”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.
This Privacy Policy describes how Haccah collects, uses, and shares Personal Data submitted on or through our website at www.haccah.com (the “Website”) by Users of our products and online services, which involve the creation and delivery of Personal Data for intake forms and related documents, including consolidated reports (the “Services” and, together with the Website, the “Haccah Platform”). This Privacy Policy applies to all users of the Haccah Platform (“Users”), who may be either: (a) medical, behavioral, health, and wellness providers and their staff or other agents or contracted business associates (“Providers”); or (b) patients or clients of such Providers (each a “Patient” and collectively “Patients”).
This Privacy Policy applies to Personal Data, which includes both Personal Information and Protected Health Information (“PHI”) provided, transmitted, or submitted through the Haccah Platform, and it also describes the choices we offer with respect to such Personal Data. PHI includes, for the purposes of this Privacy Policy, individually identifiable health information submitted by a Provider or a Provider’s “Business Associate” (as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”)), along with related Personal Information submitted in combination with PHI. Personal Information means individually identifiable personal information submitted by a Patient or by a Provider into the Haccah Platform regarding a Patient other than individually identifiable health information. Such Personal Information might include, by way of example, an address, email address, or telephone number.
Providers who are Users of the Haccah Platform and submit Personal Data including PHI are considered “Covered Entities” under HIPAA and such Providers are required to protect the confidentiality and security of your PHI. Haccah, as a contracted Business Associate with the Provider, is held to the same standard with respect to PHI maintained in the Haccah Platform, whether submitted by the Provider or by a Patient (or a representative on behalf of a Patient). Accordingly, Haccah is obligated by law to maintain and is committed to protecting the confidentiality and security of PHI.
Please read this Privacy Policy carefully to understand our policies and practices regarding your Personal Data and how we will treat it. If you do not agree with our policies and practices, your choice is not to use any part of the Haccah Platform. By accessing or using the Haccah Platform, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of the Haccah Platform after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.
If You are a Patient
This Privacy Policy does not apply to the uses or disclosures by Providers of your PHI that may occur separate and apart from the Haccah Services, or in violation of the Terms of Service of the Haccah Services. Your Provider should separately notify you, and you should inquire of your Provider, regarding how your Provider may otherwise separately collect, use and disclose or share your PHI.
This Privacy Policy applies only to Personal Data and does not apply to information that cannot be identified to any individual, household, or their devices.
Children Under the Age of 13
We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on or through the Haccah Platform or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@haccah.com.
Information We Collect About You and How We Collect It
The categories of information collected from and about Users of the Haccah Platform, include:
Contact information, meaning data by which you may be personally identified, such as name, postal address, email address, telephone number, and other identifiers by which you may be contacted online or offline.
Computer connection information, meaning details about Users’ internet connection, the equipment used to access the Haccah Platform, and usage details.
PHI submitted by Users through our Website forms for the purpose of facilitating the management and delivery of healthcare services by Providers contracted with Haccah.
Transaction information, meaning information submitted by or about a User to facilitate creating an account, purchasing Services, posting material, or requesting further information or services.
We collect this information:
From Providers who access the Haccah Platform directly, and are authorized by Patients to submit Patient Personal Data into the Haccah Platform.
From Patients who are receiving healthcare services from Providers contracted with Haccah, who give Patients access to the Haccah Platform.
Automatically as a User navigates through the Haccah Platform. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
Information You Provide to Us
The information we collect on or through the Haccah Platform may include:
Information that you provide by filling in forms on our Website in connection with registering to use our Website, creating an account, purchasing Services, posting material, or requesting further information or services.
If you manage, set-up or administer an account on the Haccah Platform on behalf of a Provider (“Manager”), the Manager’s and the Provider’s contact information.
Information provided by any User in connection with reporting a problem with our Website or the Services.
Records and copies of correspondence (including email addresses) when a User contacts us.
Details of transactions a User carries out through our Website to access the Services and to document fulfillment of Services orders.
Providers will be required to provide financial information before having access to the Haccah Platform or placing a Services order through our Website, and information about this transaction will be stored and processed by a third-party payment provider on behalf of Haccah.
PHI to be used by the Patient’s Provider.
You also may provide information intended by you to be published or displayed (hereinafter, “posted”) on public areas of the Website, or transmitted to other Users of the Website or third parties, such as a chatroom, if implemented (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable, and we cannot control the actions of other Users of the Haccah Platform with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

To create and manage Patient profiles for Providers, including for Patient intake purposes.
To facilitate communication on or through the Haccah Platform between Patients and Providers.
To maintain, analyze, customize, measure and improve the Haccah Platform.
To provide client support.
To communicate with Users and fulfill their requests.
To protect the security of the Haccah Platform.
To fulfill any other purpose for which the information was provided.
To service and provide clients with notices about their accounts with us.
To carry out our obligations and enforce our rights arising from any contracts entered into with Providers or other clients and us, including for billing and collection.
To notify Website Users about changes to the Haccah Platform or any products or services we offer or provide through it.
To allow Users to participate in interactive features on our Website.
In any other way we may describe when the information is provided.
For any other purpose with the individual’s consent.
We may also use your information to contact you or serve you advertisements or promotional offers about our own goods and services that may be of interest to you.
How We Use PHI
If you are a Patient submitting your healthcare information to the Haccah Platform, Haccah is committed to the secure protection of your PHI. As a contracted Business Associate with your Provider, Haccah may only use, access or disclose your PHI to you or to the Provider, to support the Provider’s use of the PHI by organizing and generating a report for the Provider regarding your PHI, and maintaining the PHI in our secure electronic records storage system. Haccah will not otherwise use or disclose your PHI, unless expressly authorized by you, or if Haccah is required by law to produce the PHI to a third party. Haccah’s services for your Provider with respect to your PHI are subject to and limited by HIPAA, and a Business Associate Agreement with your Provider outlining Haccah’s obligations under HIPAA.
Your Provider should separately notify you regarding how the Provider may collect, use and disclose or share your PHI.
Disclosure of Your Personal Data
We may disclose aggregated de-identified information about Users without restriction.
We may disclose Personal Data that we collect or you as a User provide as described in this Privacy Policy:
To our subsidiaries and affiliates.
To contractors, service providers, and other third parties we use to support our business, provided that, in the case of PHI, they execute and agree to be bound by a Business Associate Agreement and the terms and conditions of HIPAA.
To your specific Provider, if you are a Patient of theirs, or to you if you are a Provider of a Patient, so that the Patient can benefit from the Haccah Platform and the Provider can deliver healthcare services to the Patient.
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Haccah’s assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Haccah about the Haccah Platform Users is among the assets transferred, and such transfer, to the extent it includes PHI, is securely and confidentially held in accordance with HIPAA.
With the consent of the Patient or at your direction subject, in the case of PHI, to the limitations imposed by HIPAA.
We may also disclose Personal Information submitted by a User and, if mandated or allowed under HIPAA, PHI submitted by a User:
To comply with any court order, law, or legal process, including to respond to any valid, enforceable subpoena or governmental or regulatory request.
To enforce or apply our Terms of Service and other agreements, including for billing and collection purposes.
to protect the rights, property, or safety of Haccah, or others, and, in the case of PHI, subject to the minimum necessary requirements of HIPAA.
Note, we do not sell any of your Personal Data.
Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:
Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.
Promotional Offers from Haccah. If you do not wish to have your email address or other contact information used by Haccah for marketing communications to promote our own products or services, you can opt-out by sending us an email with your request to support@haccah.com. You can review and change your Personal Information by logging into the Website and visiting your account profile page.

We retain your Personal Data for as long as is necessary for the purposes described in this Privacy Policy, in accordance with applicable laws (including HIPAA).
Data Security
We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. For PHI, we have implemented security measures consistent with our obligations under HIPAA and the applicable Business Associate Agreement.
The safety and security of your information also depends on you. Where you have chosen a password for access to certain parts of the Haccah Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Changes to Our Privacy Policy
It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our Users’ Personal Information, we may (but have no obligation to) notify you by email to the email address specified in your account or through a notice on the Website home page. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this Privacy Policy to check for any changes.
